01.Ticket Sales

Preamble


1.1

The "Konzertfabrik Z7" maintains a ticket sales office. Purchasers of tickets (hierafter "customer") can purchase tickets for events via our sales office. The "Konzertfabrik Z7" embodies the direct contract between the event promoter and the customer.

1.2

The subject of these Terms and Conditions (hierafter "T&C") is the use of services provided by the "Konzertfabrik Z7" to the customer through its own sales channels. Agreement to these T&C shall be automatically assumed as soon as the appropriate services are used. For each such service offered by the "Konzertfabrik Z7, the customer can be asked to agree to the T & C by means of clicking of a confirmation button.

Services


The conditions of sales of the "Konzertfabrik Z7" are applied to all transactions. "Konzertfabrik Z7" is permitted to change or add to such services at any time.

3

Contract


3.1

Orders from the customer


The overview displayed by the sales channels is understood to be only an invitation to the customer to purchase tickets on offer. The customer makes his or her selection using the sales channel. The appropriate selection is shown in the shopping cart (Webshop) resp. by communication to the buyer (orders by telephone or pre-sales outlet). By confirming the order, the customer confirms his or her binding intention to purchase the selected tickets. The customer is obligated to provide full and correct information during the ordering procedure.

3.2

Confirmation of order


When a ticket has been ordered in the Webshop and the order submitted, the customer will receive a confirmation of the order by email or SMS. This does not represent acceptance of the order by the "Konzertfabrik Z7".

Delivery of the Tickets


4.1

The customer is obligated to examine the tickets immediately on receipt. Damaged or incorrect tickets sent by post or electronically must be reported by the customer to the "Konzertfabrik Z7" within seven days. After this time the tickets are deemed to have been accepted.

4.2

Use and risk shall be transferred to the customer as soon as they are dispatched from the office of "Konzertfabrik Z7". The customer is responsible for the safe-keeping of the tickets until the event. Replacement of tickets lost or damaged by the customer or lost tickets is conditionally not possible.

No Resale


All trade with purchased tickets for commercial or other profitable purposes is not permitted. Contravention can lead to the loss of the services connected to the purchased tickets as well as legal claims for compensation for damages against both the original customer and the person to whom the ticket was resold. In additions, persons who contravene this condition can be barred from purchasing tickets in the future.

Prices


The prices of tickets offered by the sales channels are inclusive of Swiss MWSt. (sales tax / VAT).

Returns, Reimbursement and Exchanges


If the date or venue of an event is changed:
If a promoter needs to change the date or the venue of an event, the ticket retains its validity irrespective of the reason for the change of date or venue. In such cases, the decision to permit the return, reimbursement or exchange of tickets lies with the promoter.

Duties of the Customer at Events


With the purchase of a ticket, the customer agrees to the rules of the "Konzertfabrik Z7" concerning security, entrance, age restrictions and other rules and acknowledges that, in case of non-compliance, he or she can be barred from the event without compensation. Please consult the Z7 website, www.z-7.ch for the appropriate rules.

Final Provisions


9.1

The place of fulfilment for the services of "Konzertfabrik Z7, including the delivery of tickets, is the office of the "Konzertfabrik Z7".

9.2

The customer waives any claims against the "Konzertfabrik Z7" for settlement.

9.3

"Konzertfabrik Z7" retains the right to change these T&C at any time. Such changes shall become effective at the time of their publication.

9.4

Should one or more of the conditions of these T&C, in part or in full, become ineffective or unenforceable, the effectiveness or enforceability of the other conditions of these T&C or of the purchase of tickets shall not be affected. In such cases, the parties shall replace the ineffective or unenforceable condition by an effective and enforceable condition, which comes closest to the commercial purpose of the condition being replaced. The same applies by analogy should there be an omission of conditions in these T&C.

9.5

Swiss law shall apply to any disputes based on these T&C or arising from the relationship between the "Konzertfabrik Z7" and the customer.

9.6

The place of jurisdiction for all disputes between the "Konzertfabrik Z7" and the customer is the location of the office of the "Konzertfabrik Z7". The "Konzertfabrik Z7" retains the right to prosecute the customer at the place of his or her domicile.

02.Webshop

General


The following General Terms and Conditions apply to all contracts, deliveries and other services. Conditions additional to or differing from these present General Terms are expressly denied. All side agreements are required to be confirmed by ourselves in writing. The Association of the "Konzertfabrik Z7? is permitted to modify or add to these General Terms and Conditions at any time. Orders submitted before any such addition or modification was made shall be handled according to the previous General Terms and Conditions.

Conditions of Purchase and Delivery


2.1

Our General Terms and Conditions apply to all orders submitted in writing, by telephone or made online and are deemed to have been accepted on submission of such orders. Orders and delivery are completed according to the published conditions.

2.2

We retain the right to make partial delivery if this is deemed to be expeditious or advantageous. This does not entail any additional postage or other costs for the customer. Special forms of delivery requested by the customer are not possible.

Prices and Payment


All prices are in Swiss Francs and are inclusive of the current MWSt. (sales tax, VAT) but exclusive of postage costs. The prices are valid at the time of the order being submitted. Our prices in the online shop are the current prices. The sales price in the online shop, published at the time of the submission of the order are valid.

Delivery


Items in stock are usually sent within 3 working days. We retain the right to make partial delivery if this is deemed to be expeditious or advantageous. This does not entail any additional postage or other costs for the customer. If the item is not in stock at the time the order is submitted, we will do our best to ensure a rapid delivery. If delivery cannot be made due to industrial action, an act of God, war, or other unpredictable occurrence, or other cause beyond our our control, the delivery date may be delayed. Should the delivery be delayed for a reason other than those given above, the customer has the right to withdraw from the contract after having set, in writing a reasonable period for delivery and threatened to withdraw if performance is not effected within the additional period. Should the non-delivery be caused by insolvency of the supplier, either or both of the parties can cancel the contract if the agreed delivery period is overdrawn by more than two months. Demands for compensation for damages for delay or non-delivery, including any incurred before the withdrawal from the contract, shall not be entertained.

Returns


You have the right to return or exchange your tickets within 10 days. Please return your tickets with the original invoice.

Transferrance of Use and Risk


Use and risk shall be transferred to the customer as soon as they are dispatched from the office of "Konzertfabrik Z7".

Warranty


The Association of the "Konzertfabrik Z7? shall ensure that the items are free of errors at the time of transferrance of Use and Risk and that they comply with the conditions of the contract. On reciept of the items, the customer should inspect them and any damage, omissions or errors must be reported by the customer to the "Konzertfabrik Z7" in writing or by telephone within seven days. After this time the tickets are deemed to be accepted and no claims can be accepted. For such complaints the customer must be able to produce evidence of the date of purchase, together with an invoice. The items in question should be returned to us together with a copy of the invoice. Such complaints do not apply to normal use or wear caused by the customer. The tickets may not be altered in any way as such alteration invalidates the guarantee.

Ownership


All tickets remain the property of the "Konzertfabrik Z7" until they are fully paid for by the customer.

Data Storage


All personal data shall be deemed to be confidential. We use your data only to complete your order and maintain customer service.

10

Jurisdiction


Swiss law is applicable to this contract. The version in the German language is binding and takes priority over translations into English. Place of jurisdiction is Liestal, canton Basel-Land, Switzerland.
